Welcome to GoodNight! This User Agreement (“Agreement”) outlines the terms and conditions that govern your use of the GoodNight app (“App”). By downloading, accessing, or using GoodNight, you agree to comply with and be bound by the terms of this Agreement.
Please read this Agreement carefully. If you do not agree with the terms, you should not use GoodNight.
1. Acceptance of Terms
By using the App, you acknowledge and agree to be bound by the terms of this Agreement and any future updates or modifications. If you do not agree to these terms, do not use the App.
2. Account Registration
To access certain features of the App, you may need to create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.
3. Use of the App
You agree to use GoodNight only for lawful purposes and in accordance with the terms of this Agreement. You may not:
Use the App to violate any local, state, or national law.
Impersonate any person or entity or mislead others about your affiliation with any entity.
Interfere with or disrupt the App’s functionality or servers.
Engage in any form of harmful or fraudulent activity.
GoodNight reserves the right to suspend or terminate your access to the App if we believe you have violated these terms.
4. In-App Purchases
GoodNight may offer in-app purchases or premium features. All in-app purchases will be processed through third-party payment processors (e.g., Google Play or Apple App Store). Payment information is handled by the respective third-party service, and we do not store your financial data.
You may be required to provide valid payment information to purchase premium content. All payments for in-app purchases are non-refundable unless otherwise stated by the third-party payment processor.
5. Privacy and Data Collection
GoodNight collects and processes personal data in accordance with our Privacy Policy, which is incorporated by reference into this Agreement. By using the App, you consent to our data collection practices as described in the Privacy Policy.
6. Intellectual Property
All content, features, and functionality of GoodNight, including but not limited to text, graphics, logos, images, and software, are owned by GoodNight or its licensors and are protected by copyright and other intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any part of the App without our prior written consent.
7. Termination of Use
GoodNight reserves the right to suspend or terminate your account and access to the App at any time, with or without notice, if we believe you have violated the terms of this Agreement. Upon termination, you must immediately cease all use of the App.
8. Limitation of Liability
To the fullest extent permitted by applicable law, GoodNight and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use or inability to use the App.
9. Disclaimers
The App is provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the App will be error-free, uninterrupted, or completely secure.
10. Indemnification
You agree to indemnify and hold harmless GoodNight, its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of this Agreement, or your infringement of any third-party rights.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws.
12. Changes to the Agreement
GoodNight may update this Agreement from time to time. We will notify you of significant changes by updating the effective date at the top of this page or by providing a notice within the App. By continuing to use the App after such changes, you agree to be bound by the revised Agreement.
